A TOUCH OF HANDZ TERMS OF SERVICE

General Use

The atouchofhandz.com website is designed to showcase the massage services they provide in the territories of St. Martin and Saint Maarten respectively. It also allows for contacting the proprietor of A Touch Of Handz for the purpose of reserving times and dates for specific massage services provided and the location where the services shall be performed.

Making Reservations

Our reservation system collects specific contact information from the persons seeking massage services in order to communicate with and confirm their reservations, update on them regarding delays or rescheduling, and for receipt of their payment.

Our customer’s personal data is not shared with any other agencies or used for any other purposes.

No credit card information is stored on our computers nor is it provided to us by our payment processing provider PayPal.

Cookies and Tracking

Our site complies with the GDPR requirements for cookie handling. Cookies are used for various purposes. Our primary cookie usage is for the booking system that requires a “session” for each person making reservations so the checkout process can identify your service selections and payment information.

Deposit Requirements

Due to the nature of the services requested whereas A Touch Of Handz is obligated to meet the subjects at their requested location (i.e. the beach, their hotel, their villa, aboard their yacht ) there are various expenses incurred. This includes:

  • Travel time to the destination
  • Cost of food and beverage for certain services that include those amenities
  • Cost of additional employees depending upon the services and options requested

Non-Refundable Deposit

A 50% deposit is requested at the time of booking in order to cover costs in the event of a no-show. This deposit is collected at the time you make your reservations online.

The customer acknowledges that the A Touch Of Handz staff has, in good faith based on Customer request for services, incurred expenses in behalf of the Customer, reserved time specifically for Customers request that can not be recuperated, was asked to travel by the Customer to the location of choice, and fulfilled their portion of the contract implemented at the time of the booking request.

IN THE EVENT OF A NO-SHOW BY THE CUSTOMER the deposit will be forfeited by Customer in order to cover the expenses incurred in good faith by A Touch Of Handz necessary to provide the services requested and the time and location specified. The no-show is a direct disregard for the commitment inferred in the making of the reservation and is solely the decision of the Customer to willfully disregard the agreement.

THE BALANCE DUE will be paid at the time and location where the requested services are rendered by A Touch Of Handz staff. The balance due will be the remaining 50% plus any additional services requested on location that were not originally included in the making of the reservation online. This could include additional personnel receiving services, food and beverages, and/or manicures.

Requests For Refunds

The advanced deposits are non-refundable for reasons outlined above. A Touch Of Handz incurs various expenses upon your request for services for which the deposit is intended to allow the recuperation of those costs. Additionally, your reservation:

  • blocks out a minimum of two hours of available booking times, 1/2 hour before and after your reserved time to allow for travel to and from the location
  • disables the ability of anyone else to book for that reserved time, resulting in the inability to recuperate the lost revenues with another Customer
  • may require the acquisition of additional employees to provide services requested or the number of persons needing services
  • may require A Touch Of Handz to incur expenses for food and beverages intended for the Customer as part of the services requested

Cancellations

In the event the Customer can not make the scheduled time and has paid their deposit they can reschedule or cancel IF the following criteria are met:

  • They have notified A Touch of Handz a minimum of 24 hours in advance of their scheduled time
  • The Customer has received an acknowledgment via text, or email, or via a phone conversation that A Touch Of Handz has received the request to cancel or reschedule
  • A Touch Of Handz has granted and conveyed the rescheduling or cancellation to the Customer via text, email, or confirmed phone conversation
  • CANCELLATIONS FOR SAME DAY RESERVATIONS – For reservations made for the same day ( example, booking in the morning for that afternoon ) the deposit is not refundable. You may, however, reschedule if requested within a minimum of 3 hours of your scheduled appointment.

NOTE: A CANCELLATION DOES NOT AUTOMATICALLY ALLOW FOR A REFUND OF THE INITIAL DEPOSIT IN THE EVENT COSTS HAVE BEEN INCURRED BY A TOUCH OF HANDZ IN THE CUSTOMER’S BEHALF AND THE REQUEST FOR CANCELLATION FALLS OUTSIDE THE ADVANCED NOTICE TIME FRAME REQUIRED.

Agreement

Acknowledgement of these terms as noted by checking the “I Agree” box at the time of the payment of the deposit and request for the confirmation of requested services as provided by A Touch Of Handz shall be the entire agreement.

Disputes

All disputes regarding payments and refunds will be handled by PayPal’s dispute center.
